Alaska May Allow Gold and Silver As Legal Tender

Only the 10th Amendment
 can save America
  • Both parties in D.C. are bought and paid for by the Elites to crush our freedoms.
  • While Washington does nothing, states across America are passing laws protecting our money, free speech and more.

(Armand's Rancho Del Cielo)  Alaska may become the latest in a growing number of states to allow gold and silver as legal tender if a bill, just passed the House, gets passed by the senate and signed by the governor.

The Anchorage Daily News reported:

JUNEAU — In the final days of the legislative session, the Alaska House passed a bill that would allow gold and silver to be used as legal tender.

House Bill 3, introduced by Big Lake Republican Rep. Kevin McCabe, would allow business owners to decide if they want to accept the precious metals as currency. The coin or bar would need to be refined and its value would need to be authenticated, meaning gold dust or nuggets could not be used.

McCabe told the House State Affairs Committee earlier in the session that one of his constituents suggested the idea to him because they did not trust the national banking system. More than 10 states have passed similar bills, including Arkansas in April.

The bill specifically exempts local governments from collecting sales tax when U.S. dollars are exchanged for gold and silver. Sales taxes on purchases made with the bullion would still apply.

Gold and Silver Legal Tender in Maine?

Gold & Silver = Freedom
Fascist governments hate untraceable
gold, silver and crypto coins.

AUGUSTA, Maine (April 18, 2023) – Last Wednesday, a Maine committee approved a bill that would make gold and silver legal tender in the state. Passage into law would eliminate barriers to using gold and silver in everyday transactions, a foundational step for the people to undermine the Federal Reserve’s monopoly on money.

Sen. Eric Brakey and nine fellow Republicans introduced Senate Bill 1270 (LD1270) on March 21. The legislation would make gold and silver in coin or bar form legal tender for all transactions as long as the buyer and seller agree as to the fair market value of the metal.

Practically speaking, this would set the stage for Mainers to use gold or silver coins and bars as money rather than just as mere investment vehicles. Declaring gold and silver legal tender would create a more favorable legal environment for the use of these precious metals in everyday transactions.

In effect, it would put gold and silver on the same practical footing as Federal Reserve notes.

On April 12, the Joint Committee on Health Coverage approved LD1270 with an “ought to pass” majority report. Ten committee members signed the “ought to pass” report with two signing on to the “ought not to pass” report.

As introduced, LD1270 included provisions to eliminate the sales tax on the sale of gold and silver. The committee amended that provision out of LD1270 because a separate bill (LD1051) with those provisions recently passed out of the Joint Committee on Taxation.

Maine could become the fifth state to recognize gold and silver as legal tender. Utah led the way, reestablishing constitutional money in 2011. Wyoming and Oklahoma followed suit, and Arkansas joins them this year with a new law that will go into effect this summer.

The effect has been most dramatic in Utah where United Precious Metals Association (UMPA) was established after the passage of the Utah Specie Legal Tender Act and the elimination of all taxes on gold and silver. UPMA offers accounts denominated in U.S.-minted gold and silver dollars. The company was also instrumental in the development of the “Utah Goldback,” described as “the first local, voluntary currency to be made of a spendable, beautiful, physical gold.”

Gold and Silver Legal Tender in Texas?

The 10th Amendment
is the Key to Freedom
  • The 10th Amendment gives states the power to tell the Feds to Fuck Off.
  • The states can protect gun rights, save children from being chemically castrated by insane parents or establish gold and silver as money.

AUSTIN, Texas. (Tenth Amendment Center) – A bill introduced in the Texas Senate would take important steps toward treating gold and silver as money instead of commodities. Passage would set the stage for the people to undermine the Federal Reserve’s monopoly on money.

Sen. Tan Parker (R) introduced Senate Bill 1558 (SB1558) on Mar. 3. The legislation would establish “specie issued by the United States” as legal tender in the state, making it receivable in payment of all public and private debts contracted for in the state of Texas.

Under Texas law, “specie” is defined as “a precious metal stamped into coins of uniform shape, size, design, content, and purity, suitable for or customarily used as currency, as a medium of exchange, or as the medium for purchase, sale, storage, transfer, or delivery of precious metals in retail or wholesale transactions.

Practically speaking, this would allow Texans to use gold or silver coins as money rather than just as mere investment vehicles.

Texas could become the fourth state to recognize gold and silver as legal tender. Utah led the way, reestablishing constitutional money in 2011. Wyoming and Oklahoma have since joined.

Texas has already taken steps to facilitate the use of gold and silver in everyday transactions with the Texas State Bullion Depository. The depository was created by a bill signed into law by Gov. Abbott in 2015. The Texas depository received its first deposits in the summer of 2018. The following year, the state exempted precious metals in these depositories from taxation.

Ultimately, depositors will be able to use a bullion-funded debit card that seamlessly converts gold and silver to fiat currency in the background. This will enable them to make instant purchases wherever credit and debit cards are accepted.

Establishing gold and silver as legal tender would take another step toward treating gold and silver as money, setting the stage to undermine the Federal Reserve’s monopoly on money.

Central Bank Digital Currency Fought by Oklahoma

Standing up for Cash
  • Imagine if there was no cash. It would be impossible to hide even the smallest transaction from the government’s eyes. Something as simple as your morning trip to Starbucks wouldn’t be a secret from government officials.

(Infowars)  There has been a lot of talk about central bank digital currencies (CBDCs). The powers that be sell CBDCs on the promise of convenience and security. But in reality, they are part of a broader “war on cash” and a push to give governments even more control and power over you and me. Digital currencies could allow governments to track and even control everybody’s spending.

But some state legislators are pushing back against CBDCs and working to implement laws to protect people in their state from this excessive federal government control.

Last week, an Oklahoma House committee unanimously passed a bill that would require brick-and-mortar businesses and government agencies in the state to accept cash for payment of goods and services. The bill would protect Oklahomans from being forced to adopt a central bank digital currency (CBDC).

Rep. Clay Staires (R) introduced House Bill 1633 (HB1633) on Feb. 6. Under the proposed law, a retail establishment would be prohibited from requiring payment by credit card or a central bank digital currency during normal business hours. Retail establishments also could not legally prohibit the use of cash, nor penalize cash customers.

“A retail establishment selling or offering for sale goods or services at retail during regular business hours shall accept cash as legal tender when offered by the buyer as payment and shall not charge a penalty for use of cash.”

The provisions would not apply to online or over-the-phone purchases, parking lots, wholesale or membership-based retail stores, or goods sold exclusively through a membership model that requires payment by means of an affiliated mobile device application.

On Feb. 22, the House Business and Commerce Committee passed HB1633 by an 8-0 vote.

Oklahoma isn’t the only state considering legislation to limit CBDCs. Provisions in a Missouri legal tender bill would prohibit any public entity of the state from requiring payment in the form of any digital currency, including a central bank digital currency (CBDC).

Federal Gun Control To Be Blocked at The State Level

State level action is the only hope

(Tenth Amendment Center)  A bill filed in the Ohio House would ban state and local enforcement of a wide range of federal gun control; past, present and future. Passage into law would represent a major step toward effectively ending federal acts that infringe on the right to keep and bear arms within the state.

Rep. Mike Loychik (R) and Rep. Jean Schmidt (R) introduced House Bill 51 (HB51) on Feb. 15. The “Second Amendment Preservation Act” would ban state and local law enforcement officers from enforcing any past, present, or future federal “acts, laws, executive orders, administrative orders, rules, regulations, statutes, or ordinances” that infringe on the right to keep and bear arms.

“All federal acts, laws, executive orders, administrative orders, rules, and regulations, regardless of whether they were enacted before or after the enactment of this section, that infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment to the United States Constitution and Section 4 of Article I, Ohio Constitution, shall be invalid to this state, shall not be recognized by this state, shall be specifically rejected by this state, and shall not be enforced by this state.”

The legislative findings emphasize that the state respects “the proper role of the federal government but rejects the proposition that such respect requires unlimited submission.”

HB293 is similar to a law that was passed in Missouri in 2021, which is already having a significant impact on ATF enforcement capabilities in that state.

America is a FAILED state... watch the unraveling accelerate

When it comes to a failed state where does one start?

A good place to start is the Fed. Since the creation of the Federal Reserve in 1913 with its endless money printing, the dollar has lost 97% of its value.

But I have noted on this Blog that something has snapped in American culture.

Both corrupt parties openly gang rape the Bill of Rights, and both have fully funded the creation of an Imperial Praetorian Guard from the FBI, CIA, NSA and IRS.

If there is any hope at all it is in the 10th Amendment. We need more Governors with balls like DeSantis to stand up and say NO to the Feds.

America is a FAILED state

Montana acts to protect a person’s electronic communications and data

HELENA, Mont.  –  On Tuesday, the Montana Senate unanimously passed a bill that would put a state constitutional amendment on the ballot to elevate the privacy of a person’s electronic communications and data to the same level as “persons, houses, papers and possessions.”

Sen. Kenneth Bogner (R-Miles City) introduced Senate Bill 203 (SB203) on Feb. 9.  If approved, the resolution would allow voters to consider an amendment to Article II, section 11 of the Montana State Constitution that would require the government to obtain a search warrant in order to access a person’s electronic data or electronic communication. The amendment would add the following highlighted words to Article II Sec. 11 of the state constitution.

“Searches and seizures. The people shall be secure in their persons, papers, electronic data and communications, homes, and effects from unreasonable searches and seizures. No warrant to search any place, or to seize any person or thing, or to access electronic data or communications shall issue without describing the place to be searched or the person or thing to be seized, or without probable cause, supported by oath or affirmation reduced to writing.”

If passed by both the Senate and House by a 2/3 vote, the proposed amendment would go before Montana voters in November 2022.

On Feb. 23, SB203 passed the Senate 50-0.

A similar ballot measure passed in Michigan in the 2020 general election.

Language in SB203 was modeled on Missouri Amendment 9, which passed in with an overwhelming 75 percent of the vote in 2014. A similar state constitutional amendment to protect “private and personal information” passed in New Hampshire in 2018.

Hawaii to ban the militarization of the police

"The state calls its own violence `law', but that of the individual `crime"
Max Stirner

  • Interesting - A solid Democrat state pushes back against a militarized Police State.

HONOLULU, Hawaii  -  Bills introduced in the Hawaii House and Senate would ban state and local law enforcement agencies from acquiring certain military equipment from federal programs.

In January, Rep. Scott Saiki introduced House Bill 1381 (HB1381), and Sen. Stanley Chang introduced Senate Bill 30 (SB30). The legislation would not only prohibit the use of impact projectiles; rubber bullets, etc., and noxious chemical agents, such as tear gas, from being used at protests or demonstrations, it would also  prohibit police departments from acquiring the following items (through purchase or otherwise):

  • Weaponized unmanned aerial vehicles
  • Aircraft that are configured for combat or are combat-coded and have no established commercial flight application.
  • Grenade launchers and grenades or similar explosives and explosive delivery devices
  • Standard issue military rifles
  • Armored multi-wheeled vehicles that are mine-resistant, ambush-protected, and configured for combat from a surplus program operated by the federal government
  • Camouflaged uniforms
  • Sound cannons, sound energy weapons, or long range acoustic devices

Law enforcement would, however, be able to petition the director of public safety, regarding the acquisition of items for specialized/tactical teams.

The proposed law would apply both to the well-known 1033 program, along with any other military surplus program operated by the federal government.

While passage of HB1381 or SB30 wouldn’t end militarization, it would keep some dangerous weapons out of the hands of police officers and set the stage for further limits in the future.

FEDERAL SURPLUS AND GRANT MONEY

Police can get military-grade weapons through a number of federal programs, including the 1033 program, and via the Department of Homeland Security through the (DHS) “Homeland Security Grant Program.” The DHS doles out over $1 billion in counterterrorism funds to state and local police each year.

According to a 2012 Senate report, this money has been used to purchase tactical vehicles, drones, and even tanks with little obvious benefit to public safety. And, according to ProPublica, “In 1994, the Justice Department and the Pentagon-funded a five-year program to adapt military security and surveillance technology for local police departments that they would otherwise not be able to afford.”

In August 2017, President Trump issued an executive order that gave a push to local police militarization. Trump’s action rescinded an Obama-era policy meant to provide greater transparency and oversight around the Department of Defense 1033 program and other federal resources that provide military weapons to local police. Biden will reportedly reinstitute the Obama policy, but it was nothing more than window-dressing. In practice, the Obama EO did little to stem the flow of military equipment to state and local law enforcement agencies.

Even with the Obama-era limits back in place, the1033 program will remain essentially intact. Military gear will continue to pour into local police agencies, just as it did when Obama was in the White House.

Arizona Bill Would Require Conviction Before Asset Forfeiture

A Blow Against The Police State

PHOENIX, Ariz. – A bill prefiled in the Arizona House would reform the state’s asset forfeiture laws to prohibit the state from taking a person’s property without a criminal conviction in most situations. The proposed legislation would build on important reforms signed into law in 2017.
Rep. Bob Thorpe (R-Flagstaff) filed House Bill 2149 (HB2149) on Jan. 9. Under the proposed law, Arizona prosecutors would not be able to proceed with the asset forfeiture process without a criminal conviction.
HB2149 is similar to another bill prefiled for the upcoming session (HB2032)
An AZCIR analysis in 2017 found that Arizona agencies seized nearly $200 million in property between 2011 and 2015 from people who may never have been charged or convicted of a crime.
In 2017, Gov. Doug Ducey signed a bill into law that enacted modest reforms to the state’s forfeiture laws and closed a loophole that enabled prosecutors to circumvent state laws by passing cases off to the feds. HB2149 would build on the foundation set in that law and further reform the state’s asset forfeiture process.
In 2017, the legislature increased the evidentiary standard necessary for the state to win a forfeiture case. It also took a big step toward closing a loophole that allows state and local police to get around more strict state asset forfeiture laws in a vast majority of situations. This is particularly important in light of a policy directive issued in July 2017 by then-Attorney General Jeff Sessions for the Department of Justice (DOJ).

Huckabee: Have Senators elected by state legislatures

Sorry, there is no going back

  • Mike Huckabee makes good points that Senators no longer represent the states.  Senators are simply the bought and paid for tools of warring Wall Street factions of billionaire cartels.
  • Unfortunately there is no going back.  The Sheeple, I mean people, think they elect Senators. The reality is they only are allowed to choose which open borders Wall Street faction will rule over them.

(CNS News)  -  It’s “[t]ime to repeal 17th Amendment,” former Arkansas Governor Mike Huckabee said in a tweet following the GOP’s failure to repeal Obamacare on Friday.
“Time to repeal 17th Amendment,” said former Governor Mike Huckabee in a tweet. “Founders had it right-Senators chosen by state legislatures. Will work for their states and respect 10th amid [sic].”
The 10th Amendment – part of the Bill of Rights – states that “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
Stating that there is an “ignorance” regarding the history of the 17th Amendment, the former governor of Arkansas did not stop there, however.
“Ignorance of history of 17th Amendment is revealed by response to my earlier Tweet,” tweeted former Gov. Huckabee. “Direct election of Senate is major cause of #swamp.”

“Silencers” Decriminalized by Tennessee Legislature

Are They Inbred in Tennessee?

  • Idiots on Parade  -  Off to the Governor's desk goes a bill to allow the manufacture and possession of firearm silencers.
  • I am a 2nd Amendment man, but there is no sane reason in the world to allow cop killers or Muslim terrorists to easily obtain silencers.
  • The truth in my statement is the Republican fool of an author calling it a "Hearing Protection" bill.  Pure bull.  There are many other ways to protect hearing.

NASHVILLE, Tenn. (May 2, 2017)  Tenth Amendment Center – Yesterday, the Tennessee House gave final approval to a bill that would decriminalize the manufacture and possession of firearm silencers in the state. If signed by Gov. Bill Haslam, the bill would help foster an environment hostile to federal gun control in Tennessee.
Sen. Steve Southerland (R-Morristown) introduced Senate Bill 921 (SB921) earlier this year. Titled the “Tennessee Hearing Protection Act,” the legislation would repeal current Tennessee statutes prohibiting the possession, manufacture, transport, repair, or sale of firearm silencers.
These devices simply muffle the sound of a gun. They do not literally silence firearms. Nevertheless, the federal government heavily regulates silencers under the National Firearms Act.
The feds charge a $200 tax on the purchase of the devices. Buying a silencer also requires months-long waits after filing extensive paperwork with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives.
The House passed SB921 by a 74-18 vote. The Senate previously passed the bill 28-1. The bill now heads to Gov. Haslam’s desk for his consideration.

Jeff Sessions: "Crackdown on Legal Marijuana"

Jeff Sessions:
"More Police State Please."

  • Neither party really gives a damn about the Bill of Rights. For their own reasons both parties want an endless expansion of Federal government power.

(Time)  -  Attorney General Jeff Sessions hinted that the Department of Justice might begin more aggressive enforcement of federal laws against recreational marijuana, even in states that have legalized it.
Speaking at the National Association of Attorneys General’s annual winter meeting on Tuesday, Sessions said that the agency might enforce laws in eight states and Washington, D.C., that have legalized recreational marijuana.
“States, they can pass the laws they choose,” he said. “I would just say, it does remain a violation of federal law to distribute marijuana throughout any place in the United States, whether a state legalizes it or not.”
Sessions, who has long opposed marijuana legalization, reiterated that view in response to a question on drug policy.
“I’m not sure we’re going to be a better, healthier nation if we’re going to have marijuana being sold at every corner grocery store,” he said.
Sessions’ comments echoed White House spokesman Sean Spicer, who predicted harsher prosecution of marijuana under the Trump Administration at a press briefing Thursday.
“I do believe you’ll see greater enforcement of it,” he said. Spicer clarified that Trump supports medical marijuana but “that’s very different than recreational use, which is something the Department of Justice will be further looking into.”
